Sacramento Driver Safety Office is the location where DMV driver license suspension hearings are held. DMV hearings are conducted before specially trained Hearing Officers who decide whether to suspend, revoke or place on probation the driving privilege of a person who has been issued a California driver's license or has driven in California. In most circumstances where the DMV orders an action against a person's driving privilege, there exists the right to a hearing before a DMV Hearing Officer to review all evidence supporting the license suspension and challenge the action. A discretionary action is one where the law permits, but does not require, DMV to order an action.

To receive a DMV hearing, a person must request the hearing within ten days of receiving notice of the action against the driving privilege. If the person receives a notice and hires a lawyer to represent them, the attorney should request the hearing on behalf of the driver and a request a stay of any suspension or other action between the request for the hearing and the issuance of a written decision. The California Driver Safety Office hearing proceedings are tape recorded and may be conducted by telephone or in person before a Driver Safety Hearing Officer of the California DMV.

At the hearing, the driver is informed of the legal grounds for the action, and has the opportunity to review and challenge the evidence of the Department of Motor Vehicles, and to present evidence, witnesses and testimony in an effort to persuade the DMV Hearing Officer to modify or rescind the action. The rules that control these hearings are found in the Vehicle Code, the Government Code (Administrative Procedures Act) and in various Appellate and Supreme Court decisions. Following the hearing, the Driver Safety Hearing Officer will make a decision to uphold (sustain), modify, or rescind (set aside) the DMV action.
